Assumption of Risk and Liability Release Agreement
I certify that I am cognizant of all inherent danger and risks associated with my or my child’s participation in the athletic activities related to the individual and group participation in athletic activities provided by Playground Sport LLC, hereafter referred to as “Releases”. I agree to the rules and policies of the Releases and the facilities used by the Releases. I agree that I shall provide health insurance and other applicable insurance to cover any personal injury or property damage sustained by myself or my child while I/he/she is participating in sporting activities or watching sporting activities provided by the releases, and insure that my or my child’s attire is proper and in good working condition. In consideration for the releases granting myself or my child permission engage in sporting activities, I hereby release, discharge, and agree not to sue Playground Sports LLC, their respective administrators, directors, agents, officers, members, volunteers, employees, contract workers, other participants, any sponsors, advertisers, owner and leasers of the premises on which the activity takes place, (each now considered one of the “Releases” herein) from all liability, claims, demands, losses or damages on my account caused or alleged to be caused in whole or in part by the negligence of the releases or otherwise, including negligent rescue operations. I further agree that if despite this release and waiver of liability, assumption of risk, and indemnity agreement, I, or anyone on my behalf makes a claim against the Releases, I will indemnify, save, and hold harmless each of the releases from any litigation, expenses, attorney fees, loss, liability, damage or cost which may incur as a result of such claim. Further, I hereby assume the risk of all injuries that may occur as a result of my and/or my child’s participation in sporting activities and agree that the Releases are not responsible for ANY medical expenses I may incur on behalf of myself or my child. I do hereby consent, authorize and grant Releases and/or duly authorized representatives to take photographs, motion pictures or videos of me or my child and further consent to the publication, circulation and dissemination of said photographs, motion pictures or videos or any duplication or facsimile thereof for any purposes it may deem proper. In granting such permission, I hereby relinquish and give to Releases all rights, title and interest I may have in the finished pictures, negatives, motion pictures or video reproductions or copies and further waive any and all right to approve and any right to compensation for the use and publication of said photographs, motion pictures or video and do release Releases from any and all claims of any nature whatsoever arising from their use.
Contagion & Covid-19 Waiver
I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing.
I further acknowledge that Playground Sports LLC and facilities rented by Playground Sports LLC have put in place preventative measures to reduce the spread of the Coronavirus/COVID-19.
I further acknowledge that Playground Sports LLC can not guarantee that I will not become infected with the Coronavirus/Covid-19 or other contagions. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 or other contagions may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Playground Sports staff, participants, partners, and affiliates.
I voluntarily seek services provided by Playground Sports LLC and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19 and other contagions. I acknowledge that I must comply with all set procedures to reduce the spread while attending my activity.
I attest that:
* I am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
* I have not traveled internationally within the last 14 days.
* I have not traveled to a highly impacted area within the United States of America in the last 14 days.
* I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.
* I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non contagious by state or local public health authorities.
* I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.
* If my condition changes I will NOT participate or attend activities.
I hereby release and agree to hold Playground Sports LLC harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act, or that may otherwise arise in any way in connection with any services received from Playground Sports LLC. I understand that this release discharges Playground Sports LLC from any liability or claim that I, my heirs, or any personal representatives may have against Playground Sports LLC with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Playground Sports LLC. This liability waiver and release extends to all owners, partners, and contractors.
